General
These Terms and Conditions ("Terms") govern your use of our website, www.madcapmusic.co.nz, and the purchase of tickets for our events. By using our site or purchasing tickets, you agree to comply with and be bound by these Terms. Please read them carefully.
These Terms and Conditions may be subject to change at any time and will become binding, with or without notification by Madcap.
Terms and conditions for the purchase of tickets will be available at the time of purchase through the authorised ticketing agent. If in the ticketing agent’s terms and conditions do not match our terms, or do not specify an answer, our terms will apply.
Ticket Purchase & Refunds
All ticket sales are final. There are no refunds, credits or exchanges on any tickets. This applies to events which have been postponed and still await rescheduling. Booking fees are non-refundable under all circumstances.
Obtaining a refund for a cancelled or postponed event
Where an Event has been postponed, it is our sole responsibility to publish plans for any new date(s) and changes to the Event’s programming, venue, timings, and terms. We may also choose to offer discretionary refunds on a case-by-case basis.
We will notify ticket holders of a cancelled or postponed Event by email and/or via their official website, or social media accounts. They will outline the options available to ticket holders who cannot attend the new date. Unless the Event terms specifically state otherwise, where no rescheduling is intended and official confirmation of this is communicated to the ticket holder, we will be able to trigger a refund instruction via the ticketing provider. This may be to issue a partial or full face value refund back to the payment card used for purchase. Booking fees are non-refundable under all circumstances.
Where a refund has been issued, an email confirmation will be sent to the email address provided at the time purchase. Refunds can take up to 10 business days to credit back to your card, depending on your bank or card issuer.
Event Entry and Conduct
Madcap reserves the right to refuse entry to any attendee for reasonable cause, including but not limited to safety concerns, security risks, or breach of terms.
Event start and end times are subject to change. Late entry may not be permitted.
Attendees are expected to behave respectfully and comply with event rules. Violations may result in ejection without a refund.
Prohibited items are not permitted to the events include in or around the venue. Exceptions will be made on a case-by-case basis for medically approved items with prior written approval via email.
Prohibited items include and are not limited to the following:
Food and drink, including commercially branded and homemade
Alcohol in any type of container.
Bottles - All bottles of any kind (cans, glass, plastic) are not permitted unless specifically allowed in the pre-event communication
Gang patches or colours.
iPads/tablets, and laptops.
Firearms, fireworks, flares, laser lights & glowsticks.
Smoking or Vaping. Please note that any vapes used while in the Venue shall be confiscated and disposed of by the security team and/or Venue Management.
Weapons of any kind, including items such as mace and tasers or weapons that may be used for ceremonial or religious purposes.
Illegal substances, if found these will be confiscated and handed to the Police after the Event.
Musical instruments, rollerblades, skateboards, scooters, bicycles, and sporting equipment.
Marker pens, spray paint, and tagging equipment.
Banners, posters, flags or signs and any unauthorised promotional, commercial, political, religious or offensive items, including but not limited to: leaflets, stickers or flyers
Animals, other than Guide Dogs.
Professional cameras and other video or audio recording equipment. This may vary from event to event, please refer to the event page for details.
Steel-toed boots.
Selfie sticks, SLRs, and hi-res video recorders such as Go-Pros and drones.
Alcohol
Anyone intoxicated will be removed from the event
A valid passport, New Zealand Drivers Licence or Kiwi Access/HANZ/Hospitality NZ 18+ card are the only accepted forms of ID for the purchase and consumption of alcohol
Alcoholic beverages must not be taken in or out of the event
You may not supply alcohol to anyone under 18 in our eveny
Privacy and Data Protection
We collect personal information for the purpose of ticket sales and event management. Your data will be handled in accordance with New Zealand’s Privacy Act.
By purchasing a ticket, you consent to the collection and use of your personal data for event-related communications and marketing purposes. You may opt-out of marketing communications at any time.
Photography and Videography
By attending the event, you consent to being photographed and filmed. Madcap may use these images and footage for promotional purposes without compensation.
Force Majeure
Madcap is not liable for any events outside its control, including natural disasters, pandemics, or other force majeure events that may prevent the event from taking place.
Release, Waiver, Discharge & Indemnity
You unconditionally release, waive and discharge, to the fullest extent permitted by law, the Released Parties from any and all Liability and you unconditionally agree to indemnify (and hold harmless) the Released Parties in respect of all such Liability.
Dispute Resolution
These Terms are governed by the laws of New Zealand. Any disputes arising under these Terms shall be resolved in the courts of New Zealand.
Acceptance of Terms
By using our website and purchasing tickets, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
